Underpinning everything we do is the belief that honest policyholders, with genuine claims, should be supported by their insurers through every step of the claims process, and should have their claims paid, in full.
Insurance law in the UK is less favourable to policyholders than in other jurisdictions, and is often counter-intuitive. The result is that insurers often have a legal right to refuse to pay claims in circumstances which would appear to a reasonable policyholder to be unfair and commercially inappropriate.
Whilst the courts in the UK have adopted an increasingly flexible approach to insurance law over the past 20 years or so, it isn’t always possible to achieve an appropriate outcome through legal means alone. For that reason, our approach at Fenchurch Law is to involve our clients’ insurance brokers as much as possible to apply appropriate commercial pressure on insurers in tandem with the legal pressure that we bring to bear. We firmly believe that policyholders achieve better outcomes to their insurance disputes, in almost all cases, when they work collaboratively with their insurance brokers.
Insurers are financial heavyweights with the ability to contest huge numbers of high value disputes at any one time, and there is an inequality of arms between the majority of insurers and almost every policyholder. Even the most significant policyholders rarely provide sufficient premium income to their insurers to be able to compel their insurer to “do the right thing” by their own commercial pressure alone.
On the other hand, insurers rely heavily on their relationships with insurance brokers, and those brokers are able to exert significantly greater commercial pressure on insurers than even the largest policyholders. Having a proactive and supportive insurance broker on your side is therefore vitally important to any policyholder.
