The Talks
In a break from tradition, this year’s symposia are built around a single case study, constructed from a series of real coverage disputes, which touches on issues faced by each of the firm’s five practice groups. Unla Quay Pty Ltd is a most unfortunate policyholder, and suffers a number of losses for which it seeks indemnity under its various policies, which include PDBI; Construction All Risks; Latent Defects; Environmental Liability; and D&O.
Construction Risks
The Construction Risks segment will look at aggregation under a Construction All Risks policy, how to calculate the cost of improvement under the LEG3 defects exclusion, and whether there is cover for excavating defective material in order to access and repair damaged insured property.
Reinsurance & International Risks
The Reinsurance & International Risks segment will look at what happens when a policyholder settles with an insurer at the same time as the insurer settles with its reinsurers, and one of the reinsurers doesn’t pay its share.
Products & Environmental Risks
The Products & Environmental Risks segment will examine the triggers for cover under an Environmental Liability Policy and the issue of double/other insurance.
Financial & Commercial Risks
The Financial & Commercial Risks segment will cover the issue of consent, allocation, and the insurability of fines and penalties.
Property Risks
The Property Risks segment will cover the operation of exclusions such as gradual deterioration and wear & tear that act as a barrier to cover under property damage policies, as well as the extent of cover available under latent defect policies for the costs of remediating fire safety defects, with particular reference to cladding & compartmentation issues.
